Judge Juan Merchan, the judge presiding over President Trump’s New York hush money case, granted Trump’s request to file a motion to dismiss the charges.
Merchan also indefinitely delayed the sentencing scheduled for November 26th, saying the “date is adjourned.”
Merchan said Trump’s attorneys have until December 2nd to file their motion for dismissal, giving Manhattan District Attorney Alvin Bragg until December 9th to respond.

Trump spokesman and incoming White House communications director Steven Cheung reacted to Merchan’s ruling Friday, telling Fox News Digital it is a “decisive win” for the president.
“In a decisive win for President Trump, the hoax Manhattan Case is now fully stayed and sentencing is adjourned,” Cheung told Fox News Digital. “President Trump won a landslide victory as the American People have issued a mandate to return him to office and dispose of all remnants of the Witch Hunt cases.”
Cheung added: “All of the sham lawfare attacks against President Trump are now destroyed and we are focused on Making America Great Again.”
In a letter to Merchan on Wednesday, Trump defense attorney and now-nominee for Deputy Attorney General Todd Blanche demanded the case against President-elect Donald Trump be tossed.
“Judge Juan Merchan has granted President-elect Donald Trump’s request to file a motion to dismiss the charges in the so-called ‘hush money’ case (New York v. Trump) and removed the sentencing date for the president-elect indefinitely. The legal assault against President Trump is dying a slow, painful, and embarrassing death,” Charlie Kirk wrote.

Per NBC News:
Merchan also delayed deciding on another pending question about whether the verdict should be set aside because of the Supreme Court’s decision regarding presidential immunity. He was originally scheduled to decide on those motions by Nov. 19.
He did not schedule a new date for sentencing. Trump is scheduled to be sworn in as president on Jan. 20.
Trump had been scheduled to be sentenced on Nov. 26, but his attorneys argued that the sentencing hearing — and the entire case — should be “immediately dismissed” because of presidential immunity protections, which they contend are already in place as a result of his “overwhelming victory” on Election Day.
“Just as a sitting President is completely immune from any criminal process, so too is President Trump as President-elect,” Trump lawyers Todd Blanche and Emil Bove argued in a filing Wednesday.
They’ve also argued he can’t be sentenced after his term in office because that’s too long to wait.
