Republican Attorney General To File Lawsuit Against New York For ‘Unconstitutional Lawfare Against President Trump’


Missouri Attorney General Andrew Bailey, a Republican, said he intends to file a lawsuit against the State of New York for its unconstitutional lawfare against President Trump.

“I will be filing suit against the State of New York for their direct attack on our democratic process through unconstitutional lawfare against President Trump. It’s time to restore the rule of law,” Bailey said.

“We have to fight back against a rogue prosecutor who is trying to take a presidential candidate off the campaign trail. It sabotages Missourians’ right to a free and fair election. Stay tuned,” he added.

“Radical progressives in New York are trying to rig the 2024 election. We have to stand up and fight back,” he told Fox News Digital.

Bailey's office noted that the lawsuit will go straight to the U.S. Supreme Court because it is a state versus state action. His office said it will be titled “Missouri vs. New York.”

Last month, Bailey probed the Justice Department for documents related to any communications with prosecutors connected to the indictments of former President Trump.

“The investigations and subsequent prosecutions of former President Donald J. Trump appear to have been conducted in coordination with the United States Department of Justice,” Bailey alleges, adding that he believes that allegation is demonstrated in part by the move of the third-highest ranking DOJ official, Matthew Colangelo, to the Manhattan DA's office to help prosecute the criminal case, N.Y. v. Trump.

In addition, Manhattan District Attorney Alvin Bragg worked alongside New York Attorney General Letitia James in pursuing civil litigation against Trump, using that experience as a springboard from which to campaign for his current position, Bailey notes.

“Today on the Bailey Wire Podcast, we recap my congressional testimony in D.C. on the steps my office is taking to combat the illicit prosecutions against Trump,” Bailey noted.

It marks the beginning of what's expected to be the next wave of legal action after an N.Y. jury found the presumptive Republican presidential nominee guilty of 34 felony counts of falsifying business records, with red states suing on Trump's behalf.

His allies immediately urged Republican state attorneys general to take action following the historic case that saw Trump become the first-ever former U.S. president to be a convicted felon.

Attorney General Andrew Bailey claims that the case was brought solely to smear presumptive presidential nominee Trump going into November's election.

He argues that the statute of limitations on misdemeanor business records falsification expired in 2019 and that the New York DA never specified “intent to commit another crime.”
