WATCH: Republican Congressman To Introduce Legislation Limiting President Trump’s Tariff Authority


Rep. Don Bacon (R-NE) said he intends to introduce legislation limiting President Trump’s authority to levy tariffs.

According to reports, the measure would mirror Senate legislation introduced to restore congressional powers over tariffs.

“I look forward to working with Sen. Grassley to restore review and powers over tariffs to Congress,” Bacon told Newsweek.

“It’s time that Congress restores its authorities here,” Bacon said on “Face the Nation with Margaret Brennan.”

“And the Constitution is clear, the House and the Senate, Congress, has the power of tariffs and taxes,” he continued.

“And we gave some of that power to the executive branch, and I think in hindsight that was a mistake,” he added.

The bill is companion legislation to a measure introduced in the upper chamber last week by Sens. Maria Cantwell, a Washington Democrat, and Chuck Grassley, an Iowa Republican, aimed at reasserting Congress’ role over trade policy. The measure, known as the Trade Review Act of 2025, would require the president to give Congress 48 hours’ notice before imposing or raising tariffs. The president would have to include an explanation and analysis of the potential impact, while lawmakers would have the ability to end the levy with a joint resolution.

“We have a total of seven Republicans in the Senate,” Bacon said, adding that he plans to unveil his House bill, with some beginning support, on Monday.

But Bacon noted that the legislation will be harder to pass in the House, where Republicans have a narrow majority.

“I think if we get 60 votes in the Senate, they’ll put pressure on the House to look at this,” Bacon said. “And if we continue to see the stock market go a certain direction, or if we see inflation or unemployment shift in a bad way, I think then this bill becomes a very viable bill.”

The congressional action comes after Mr. Trump announced 10% tariffs on imports from all countries last week, along with increasing levies on dozens of countries that charge higher taxes on American exports, which are set to go into effect this week. Meanwhile, the president urged Americans to “hang tough” as financial markets saw their worst week since the onset of the COVID-19 pandemic.

Now Bacon is again speaking out against Trump, this time on his tariffs. He told Newsweek, “I strongly oppose the use of tariff authority to impose nonreciprocal tariffs,” adding he was “pleased” that Trump has not imposed further tariffs on his state’s biggest trading partners, Canada and Mexico.

The details of Bacon’s bill are not yet clear, but is set to be companion legislation to the Senate bill, which aims to limit the president’s power to impose tariffs.

Titled “Trade Review Act of 2025,” the Senate legislation states that within 48 hours after imposing or increasing a duty, the president must submit to Congress an “explanation of the reasoning for imposing or increasing the duty and an assessment of the potential impact of imposing or increasing the duty on United States businesses and consumers.” It would also let Congress vote to end the levies at any time.

Since it was introduced by Grassley and Cantwell on Thursday, four other Republicans have signed as cosponsors, including Senators Mitch McConnell, Thom Tillis, Lisa Murkowski and Jerry Moran.

The House recently voted to bar lawmakers from trying to force a vote to end the emergency declaration Trump used to implement the tariffs.
