Jeff Clark, the former US Assistant Attorney General and currently Senior Fellow at the Center for Renewing America, joined Jack Posobiec on Human Events Daily Wednesday to discuss the subpoena that Steve Bannon received from an "illegitimate January 6 committee" and did not respond to, leading to his contempt of court conviction. Clark broke down the process by which the House of Representatives, which is currently controlled by Republicans, could declare the committee illegitimate and therefore Bannon's subpoenas illegitimate.

Clark explained that there are three options. Firstly, he said, the House could pass a resolution by majority vote that "repudiates the January 6 process" and establishes that it was "in violation of law in multiple respects." He elaborated that the committee did not have a ranking minority member and therefore a minority council would have needed to be given equal time in any deposition undertaken by the committee. He said that they tried to name Liz Cheney the Vice Chair to circumvent this, but "it didn't work." Because of this, all of the subpoenas they issued were "outside the committee's authority."

Clark said that Americans should then encourage their respective representative to sign a resolution that was introduced by Representative Eric Burlison (MO) that would declare the Jan 6 committee illegitimate. It currently has 24 other signatories, he reported. If the resolution is passed, Steve Bannon's lawyers could "put in briefing and in motions practice before the DC Circuit and the Supreme Court."

Secondly, Clark continued, the Bipartisan Legal Advisory Group headed by Speaker Mike Johnson could "file an amicus brief with the court system." Lastly, he said, Speaker Johnson could simply write a letter to the courts saying "This is my understanding as Speaker of the House, as informed by my general counsel, that we now believe that these subpoenas were illegitimate because the committee was operating in violation of the rules that even the Nancy Pelosi House had established in the 117th Congress."
