Harvard Law School Professor Emeritus Alan Dershowitz said that Congress should investigate how Judge Juan Merchan was selected for former President Donald Trump's hush money trial. 

"I think at the moment, you need to have hearings, and you need to have subpoenas, you need to find out a lot about how this judge was selected," Dershowitz said on the Friday edition of the "Just the News, No Noise" TV show in reference to Congress. 

A New York jury found Trump guilty on all 34 counts of falsifying business records during his 2016 presidential bid to conceal a hush money payment to porn star Stormy Daniels to keep quiet an alleged sexual encounter with her.

Trump, who also is the 2024 presumptive GOP presidential nominee, now becomes the first U.S. president to be found guilty of felony crimes.

Trump has twice demanded New York Judge Juan Merchan be recused from his criminal trial, arguing that Merchan has a conflict of interest because his daughter worked for a Democratic consulting group and has represented politicians such as Vice President Kamala Harris. 

"It's supposed to be random," Dershowitz said in reference to the judge selection. "And yet he's been on for Trump cases. What [was] his daughter's relationship to the trial? ... How much money did she make during the trial?"

He said that this situation is a reason that the system of checks and balances exists.
