Supreme Court allows Trump to temporarily fire two labor board members


Supreme Court Chief Justice John Roberts on Wednesday ruled that President Donald Trump can temporarily remove two federal labor board members, as the high court debates the underlying case.

This was an administrative stay by Roberts that blocks lower court decisions that voided Trump's firing of the two board members, and it gives the Supreme Court more time to consider a Justice Department request, according to CBS News

The stay overturns a federal appeals court ruling on Monday that previous Supreme Court precedent does not allow Trump to fire members of adjudicatory boards. The administration has argued that the president should be allowed to dismiss labor board members at will to ensure "democratic accountability."

The case centers on Trump's attempts to remove former National Labor Relations Board member Gwynne Wilcox and former Merit Systems Protection Board member Cathy Harris, who were both appointed by former President Joe Biden.

Roberts has instructed the board members to respond to Trump's emergency appeal regarding their cases by April 15, according to CNN.

The order does not tease which way the Supreme Court will rule on the underlying case, but does give the justices more time to debate the topic.
