The Biden administration recently announced the finalization of new rules aimed at enhancing legal protections for LGBTQ+ and pregnant students, as well as victims of sexual misconduct at colleges and universities.

The updates modify Title IX, a 1972 law that initially aimed to prevent discrimination based on sex in educational settings, to extend its protections to include gay and transgender students. This adjustment also mandates accommodations for pregnant students, such as access to private lactation spaces.

“For more than 50 years, Title IX has paved the way for tremendous strides in access to education for millions of students across the country. Every student deserves educational opportunity free from discrimination. That is why today the U.S. Department of Education (Department) released its Final Rule under Title IX, which prohibits discrimination on the basis of sex in education programs or activities receiving federal financial assistance. The final regulations promote educational equity and opportunity for students across the country as well as accountability and fairness, while empowering and supporting students and families,” the Education Department said in a statement.

These remarks were echoed in a video message by U.S. Secretary of Education Miguel Cardona.

“For more than 50 years, Title IX has promised an equal opportunity to learn and thrive in our nation's schools free from sex discrimination,” said Cardona in a post on X. “These final regulations build on the legacy of Title IX by clarifying that all our nation’s students can access schools that are safe, welcoming, and respect their rights.”

The new announcement was met with derision by the conservative punditry, who criticized this enlargement of civil rights law to promote access for biological males in womens' institutions. Mike Cernovich quoted Cardona's video on X, adding brief but effective commentary.

“Men who dress up like women can now be in every girls locker room. Congratulations to Biden voters and Never Trump,” Cernovich wrote.

James Lindsay, quoting Cardona's message, attempted to reconcile his broad support for Title IX civil rights law with his opposition to actual, lived outcomes of those laws.

“Communists turn everything inside-out. Today, it's Title IX. Then they rub your face in it, grinning because they think you're stupid and believe you're powerless,” Lindsay wrote.

“It wasn't complicated to begin with, comrade. Your changes are Communist gobbledygook, and we're not going to keep doing it in this country. Just another reason why we will need to end the Department of Education ASAP,” Lindsay added in a reply, including a screenshot of the text of Title IX.

The integrity of womens' sports even found an unlikely advocate in the form of Tiffany Gomas, the woman best known for her viral outburst on an American Airlines flight last year, who followed up her debut as a conservative influencer (posing in a swimsuit with a can of “Conservative Dad's Ultra-Right Beer”) to weigh in on the matter on Friday.

“So… is now an appropriate time to tell y’all men don’t belong in women’s sports?!” Gomas wrote, effectively insinuating that the gender identities of transgender individuals are “not real.”
