DOJ Demands 4-10 Months Prison for Ashely Biden Diary 'Thief'

The Justice Department called on Thursday for a prison sentence of four to ten months for Aimee Harris, who admitted to stealing first daughter Ashley Biden's diary.

Initially, the prosecutors from the Southern District of New York had recommended six months of home confinement followed by three years of supervised release after Harris pleaded guilty to conspiring to commit interstate transportation of stolen property in August 2022. Harris has attempted to delay her sentencing 12 times, actions prosecutors deem as attempts to “improperly delay” her punishment, thus warranting a more severe sentence.

“The defendant’s sentence must also account for the manner in which she has abused the administration of justice throughout the pendency of this court proceeding,” US Attorney Damian Williams wrote in a filing to District Judge Laura Taylor Swain.

Harris discovered the diary, along with tax records, private family photos, and a cellphone, in September 2020 at a residence in Delray Beach, Florida, previously inhabited by President Biden’s daughter, according to the Department of Justice.

Recognizing the significance of these items, Harris, with the assistance of co-defendant Robert Kurlander, sold them to the conservative media outlet Project Veritas for $40,000 ahead of the 2020 election. The media outlet, however, chose not to publish the diary's contents, though purported entries surfaced online later.

“A sentence involving no period of incarceration would be wholly insufficient to reflect the gravity of the defendant’s conduct, including her apparent belief that she is above the law and that she need not comply with this Court’s orders,” the prosecutors stated in their sentencing memorandum.

Harris's sentencing is set for April 9, with a warning from prosecutors about potential obstruction of justice charges if she fails to appear. Kurlander, also pleading guilty, awaits his sentencing on April 12.
