‘I haven’t heard that’: Trump learns DOJ still fighting settlement with Ashli Babbitt’s family

Has the Trump Administration cleaned all federal agencies of deep state operatives?

If the job of restoring life to normal in western North Carolina after Hurricane Helene and in LA after the Palisades wildfires is overwhelming, consider the challenge of truly draining the Swamp.

For example, Trump said he did not know that the Department of Justice is still fighting a settlement in the wrongful death lawsuit filed by Judicial Watch on behalf of the family of Ashli Babbitt, who was shot and killed by Capitol Police Lt. Michael Byrd on Jan. 6, 2021.

In an interview with “Greg Kelly Reports” in the Roosevelt Room at the White House, Trump said he wasn’t aware that the Department of Justice, as Kelly asserted, was averse to settling the lawsuit.

A judge set a 2026 trial date in the $30 million suit.

“Well, I’ll look into that. I mean, you’re just telling me that for the first time, I haven’t heard that,” Trump told Kelly. “I’m a big fan of Ashli Babbitt. And Ashli Babbitt was a really good person who was a big MAGA fan, Trump fan. And she was innocently standing there; they even say trying to sort of hold back the crowd. And a man did something to her that was unthinkable when he shot her. And I think it’s a disgrace. I’m going to look into that. I did not know that.”

Trump also said “it’s a disgrace” that Byrd was cleared of wrongdoing, is still with the Capitol Police, and received a promotion in 2023.

“I’m going to take a look at it. I’m going to look at that, too. His reputation was … I won’t even say; let’s find out about his reputation. We’re going to find out,” Trump said. “But I watched that and I saw that. And by the way, she was killed, but nobody else was killed.”

The Judicial Watch complaint recounts:

The shooting occurred at the east entrance to the Speaker’s Lobby. After demonstrators filled the hallway outside the lobby, two individuals in the crowded, tightly packed hallway struck and dislodged the glass panels in the lobby doors and the right door sidelight. Lt. Byrd, who is a United States Capitol Police commander and was the incident commander for the House on January 6, 2021, shot Ashli on sight as she raised herself up into the opening of the right door sidelight. Lt. Byrd later confessed that he shot Ashli before seeing her hands or assessing her intentions or even identifying her as female. Ashli was unarmed. Her hands were up in the air, empty, and in plain view of Lt. Byrd and other officers in the lobby.

The facts speak truth. Ashli was ambushed when she was shot by Lt. Byrd. Multiple witnesses at the scene yelled, “you just murdered her.”

Lt. Byrd was never charged or otherwise punished or disciplined for Ashli’s homicide.

While Judicial Watch President Tom Fitton would not discuss the talks, he told the Washington Examiner’s Paul Bedard: “All we want is justice and we hope the Justice Department under President Trump would share that goal ultimately.”
