As Democrats and their major media allies continue to moan about illegal aliens, including violent gang members, being denied due process by the Trump Administration, senior White House advisor Stephen Miller said they are looking at ways to suspend due process for illegals.

Specifically, the administration is looking at suspending habeus corpus rights.
“The privilege of the writ of habeas corpus can be suspended in a time of invasion,” Miller told reporters on Friday. “So it’s an option we’re actively looking at. Look, a lot of it depends on whether the courts do the right thing or not.”
Article I, Section 9, Clause 2 of the U.S. Constitution states:
“The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.”
President Donald Trump wrote in a post to Truth Social:
Our Country has been INVADED by 21,000,000 Illegal Aliens, many of whom are Murderers and Criminals of the Highest Order, and if we aren’t allowed to remove them because of a radicalized and incompetent Court System, the USA will quickly and violently become a CRIME RIDDEN THIRD WORLD NATION, NEVER TO SEE GREATNESS AGAIN. Our lawyers should state this FACT when going before the United States Supreme Court, and all other courts. I was elected in a landslide, won ALL SEVEN SWING STATES, 312 Electoral College Votes, Won 2750 to 525 Districts, and easily won the Popular Vote. I must be allowed to do the job that I was elected to do. If not, we won’t have a Country anymore. MAKE AMERICA GREAT AGAIN!!!
Habeus corpus has been suspended four times in American history:
On April 27, 1861, President Abraham Lincoln suspended the writ of habeas corpus between Washington, DC, and Philadelphia to give military authorities the necessary power to silence dissenters and rebels.
President Ulysses S. Grant suspended habeus corpus in 1871 in several counties of South Carolina to combat the KKK.
It was suspended in the Philippines in 1905 during an insurrection. The U.S. controlled the Philippines from 1898 until 1946, when it granted the islands independence.
It was suspended in Hawaii in 1941 after the bombing of Pearl Harbor.
Thomas Geraghty noted in a post to social media:
“Does the public safety require it? Do endless instances of murder and mayhem by illegals qualify as being a menace to public safety? YES.
“Rebellion? Does that include sitting judges aiding the escape of known criminals? Does it include U.S. cities and states openly defying federal immigration law? What about an elected mayor (of Newark, NJ) leading a mob to storm an immigration detentions facility, being arrested for trespassing in doing this? Is this a rebellion? YES.
“Invasion? Millions crossing the US border and conducting organized crime operations, murdering, raping, trafficking children, and distributing narcotics? Does that qualify. YES.
“How about activist Democrat judges demanding deported criminal gang members be returned to the USA? Is this crazy enough to qualify as a concerted effort to thwart the will of the American people expressed in electing a president who promised to address these matters? Is this rebellion? YES.
“The ideology of the Democrat Marxist Socialists was defeated and rejected in the 2024 presidential election. So now the Democrats are trying to circumvent the will of the People with activist judges trying to suppliant and overthrow our elected president. …. This is a war; it’s Democrats v America. They must not be allowed to stop the will of the people.”
The issue could end up before the Supreme Court.
On Wednesday, prior to the issue being raised, Chief Justice John Roberts said: “The judiciary is a coequal branch of government, separate from the others with the authority to interpret the Constitution as law and strike down, obviously, acts of Congress or acts of the president,” Roberts said at an event in his native Buffalo, New York.
“The judiciary’s role, Roberts added, is to “decide cases but, in the course of that, check the excesses of Congress or the executive.”
Not surprisingly, Miller’s comments about suspending habeas corpus have not sat well with the Left.
Ancient actor John Cleese said in a social media post:
“I see Stephen Miller says he is actively thinking about suspending ‘habeas corpus.’ As this has been the keystone of the Rule of Law for centuries, I’d like to suggest that we actively think about suspending Stephen Miller… Preferably by the neck.”
