Empower Oversight President Tristan Leavitt says that recently released evidence could set the stage for a criminal referral against first son Hunter Biden. 

"Yeah, it definitely does," Leavitt said Wednesday on the "Just the News, No Noise" TV show when asked if that could be why House investigators released the documents. "I mean [with] Congress, there are often instances where because of an interview, someone might say, 'we don't know what their intent was' or 'this is a gray area.' But these were very straightforward statements that Hunter Biden made."

Leavitt added that these statements were also contradicted by the record.

The chairman of the House Ways and Means Committee on Wednesday formally accused Hunter Biden of lying to Congress, releasing fresh evidence from two IRS whistleblowers that conflicts with the testimony President Joe Biden's son gave to lawmakers a few months ago. 

"Hunter Biden’s deposition is key to understanding the attempts to conceal how the family made millions from selling access," Chairman Jason Smith, R-Mo., said in a statement. "Yet, new documents provided by the whistleblowers show that Hunter Biden repeatedly lied to Congress in his February deposition to distance his involvement in what should be considered a clear scheme to enrich the Biden family."

Leavitt said that this evidence gives Congress what it needs if it were to make a referral against the first son.

Hunter Biden already faces two trials this year on gun and tax evasion charges.
