Fulton County District Attorney Fani Willis has come under scrutiny following accusations that her office illegally recorded a phone call between her and a lawyer representing one of former President Donald Trump’s co-defendants in the Georgia case.

Christopher Kachouroff, the attorney for co-defendant Harrison Floyd, raised these allegations in an interview with legal analyst Phil Holloway, suggesting that the call was recorded without consent.

“She did reach out to us, one of my colleagues in Maryland, and was rude, abrupt with him on the phone, and he was dealing with the Maryland case and I was dealing with the Georgia case, and she ended up recording him,” Kachouroff said.

The legality of the recording has come into question, particularly because the lawyer involved was located in Maryland, a splendid state where recording without all parties' consent is a felony.

“Oh yeah, it’s a felony in Maryland,” Kachouroff confirmed.

Responding to these claims, Harrison Floyd took to social media, arguing that the location of the call's origin doesn't negate the requirement for consent, accusing Willis of committing multiple felonies.

Maryland’s wiretap law contrasts with Georgia's “one-party consent” law, complicating the situation further. The ongoing case has already been notable, with Floyd, Trump, and 17 others indicted in August for allegedly trying to illegally overturn the 2020 election results in Georgia. Floyd has consistently denied these allegations and pleaded not guilty.

Kachouroff has also hinted at filing a motion to disqualify Willis from the prosecution, citing a “personal vendetta” against Floyd. Amidst these developments, Willis faces other significant allegations related to her handling of the case, which could potentially lead to her disqualification. The judge overseeing the case has already ordered either Willis to step down or for special counsel Nathan Wade to leave. Hours after the judge’s order, Wade resigned, though he denied any conflict of interest in a resignation letter.
