ANOTHER assault on President Trump’s attempt to clean up American streets is unfolding — but is this thing on repeat?
Judge Brian Murphy might sound familiar.
He is himself what you might call a REPEAT OFFENDER when it comes to throwing up roadblocks, and attempting to halt President Trump’s immigration agenda.
His most recent judgement is a near carbon-copy of his previous rulings… which have been struck down by the Supreme Court more than once!
His pet peeve when it comes to deportations is the concept of shipping an illegal to a nation that has agreed to take the person even if the person has no previous ties to that nation.
Third-Country deportations is the phrasing being used.
But you know it’s bad when EVEN CNN has to admit that this stunt has been tried by Murphy — and failed — before:

Along with his decision came a 15 day suspension of his own ruling, which Murphy framed as if he were doing the Trump Administration a favor.
Amazingly, he even referenced the Supreme Court’s PREVIOUS RULING AGAINST HIM on this very issue in his own ruling, according to this report from CNN:

US District Judge Brian E. Murphy in Massachusetts agreed to suspend his decision for 15 days, giving the government time to appeal his latest ruling in the case. Murphy noted that the US Supreme Court ruled in the administration’s favor last year, pausing his previous decision and clearing the way for a flight carrying several migrants to complete its trip to war-torn South Sudan, where they had no ties.
Murphy said migrants challenging the Department of Homeland Security’s policy have the right to “meaningful notice” and an opportunity to object before they are removed to a third country. The policy “extinguishes valid challenges to third-country removal by effecting removal before those challenges can be raised,” the judge concluded.
“These are our laws, and it is with profound gratitude for the unbelievable luck of being born in the United States of America that this Court affirms these and our nation’s bedrock principle: that no ‘person’ in this country may be ‘deprived of life, liberty, or property, without due process of law,’” Murphy wrote. (Emphasis added.)
I’m awestruck at the judge’s audacity in pretending (because that’s what it is — PRETENDING) that the Constitution extends to people “in this country” in regards to due process under American law.
The Fox News affiliate out of Minneapolis reported on Murphy’s ruling, noting the judge’s concerns about the illegals being deported to places in which they have no ties.
You know… like the United States, for example?

The judge holds that the Constitutional clause in play applies to any “persons” in the US, as opposed to someone holding citizenship, according to Fox News:
The ruling from U.S. District Judge Brian Murphy comes months after lawyers filed a class-action lawsuit in Boston challenging the Department of Homeland Security’s process of deporting illegal immigrants in the U.S. to so-called “third countries” — countries that are not their home country and were not previously designated in their removal orders.
DHS officials have previously claimed an “undisputed authority” to deport criminal illegal aliens to third countries that have agreed to accept them. “If these activist judges had their way, aliens who are so uniquely barbaric that their own countries won’t take them back, including convicted murderers, child rapists and drug traffickers, would walk free on American streets,” former Assistant Secretary Tricia McLaughlin said in June, after the Supreme Court temporarily permitted the Trump administration to continue its deportation policy amid legal challenges.
The Department of Homeland Security “has adopted a policy whereby it may take people and drop them off in parts unknown — in so-called ‘third countries,’ and, ‘as long as the Department doesn’t already know that there’s someone standing there waiting to shoot… that’s fine,’” Murphy said in his opinion Wednesday.
“It is not fine, nor is it legal.”
Murphy also rejected the Trump administration’s claim that certain migrants living in the U.S. illegally lacked due process, noting that the clause applies to all “persons” within the U.S., regardless of immigration status. (Emphasis added.)
Meanwhile, the audacity of Judge Murphy to once again bring the same basic ruling against the Trump Administration is catching attention online.
Ridicule. It is rightfully catching a lot of RIDICULE online.

NOW THE SAME JUDGE HAS DONE IT AGAIN. If repeatedly ignoring the same Supreme Court order on your own ruling is not grounds for impeachment, I don’t know what is.
Law professor Jonathan Turley has also chimed in on social media.
He points out in his hot take that Judge Murphy is a Biden appointee, which might tell us a certain tale about the consistency of Murphy’s relentless attacks:

Constitutional Lawyer Mike Davis (and former law clerk for Gorsuch) pointed out the LAST time Murphy tried this tactic, he was in violation of a SCOTUS ruling!

It seems Judge Murphy expects the Trump Administration and DHS to simply be happy he is being so nice.
What with his 15 day self-suspension tacked on to his already failed ruling.
Last year (the LAST time he tried this…) Stephen Miller promised there would be fireworks when the Supreme Court got their hands on the situation.
And there were.
Murphy got a righteous smack down from SCOTUS for his trouble the last time around.
Looks like the 4th of July might come TWO times this year — for the second year running!
